1. About these terms
These Website Terms of Use (Terms) apply when you visit anovahealth.com.au (Site), join our waitlist, complete an enquiry form, or use any other feature of the Site. By using the Site you agree to these Terms.
The Site is operated by Anova Health Services Pty Ltd (Anova, we, us, our).
These Terms apply only to your use of the Site. They do not govern any clinical service provided by Anova. When Anova’s clinical service is operating, separate Patient Terms will apply to that service. Those terms will be provided to you before you become a patient and will set out the specific obligations and rights that apply to the clinical relationship, including practitioner consultations, prescriptions, allied health referrals, and pharmacy dispensing arrangements.
2. What’s on the Site
The Site is currently a pre-launch information and waitlist site. It tells you about Anova, the program we are building, the people behind it, and how the service will work when it launches. It also lets you join our waitlist or contact us about a partnership or general enquiry.
We are not currently providing clinical services through this Site. Joining the waitlist does not create a clinician–patient relationship. No prescription, diagnosis, treatment plan, or medical advice is being provided. If you need medical care now, please contact your GP or, in an emergency, call 000.
3. Information on the Site is general
Health and wellbeing information published on the Site is general in nature. It is provided for educational purposes and to help you think about your own health. It is not a substitute for professional medical advice, diagnosis, or treatment.
You should not rely on information on the Site to make decisions about your own care. Always seek the advice of your GP or another qualified health professional with any questions you have about a medical condition or treatment.
We take care to ensure information on the Site is accurate and current at the time of publication. Health and medical knowledge changes, and information may become out of date. We do not guarantee that all information on the Site is current at the time you read it.
4. Eligibility
The Site is intended for use by people who:
- Are at least 18 years old
- Live in Australia
- Are using the Site for personal or professional information purposes
If you are not in one of these categories, please do not provide personal information through the Site.
5. Acceptable use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose
- Provide false, misleading, or stolen information
- Attempt to gain unauthorised access to any part of the Site, our systems, or another user’s account
- Interfere with the operation of the Site, including by introducing viruses or malicious code
- Scrape, harvest, or extract data from the Site without our written permission
- Use the Site to send unsolicited marketing communications or to impersonate another person
- Reproduce, republish, or commercially exploit content from the Site without our written permission, except as permitted in section 7
6. Waitlist and enquiry forms
When you join our waitlist or submit an enquiry:
- You are giving us permission to contact you about Anova, including waitlist updates, service launch information, and content you have asked to receive
- You can opt out of any non-essential communications at any time using the unsubscribe link in our emails or by contacting us
- Joining the waitlist does not guarantee you will be accepted as a patient when the service launches. Acceptance will be based on clinical eligibility assessed by a registered health practitioner at that time.
- We do not currently collect health information through these forms. Please do not include details of your health, conditions, medications, weight, or other clinical matters. If you do, we will delete that information and ask you not to send further clinical detail until our clinical service is operating.
7. Intellectual property
All content on the Site (text, images, logos, graphics, audio, video, layout, and design) is owned by Anova or used under licence. The Anova name, logo, and brand elements are trade marks of Anova Health Services Pty Ltd (some of which are the subject of pending IP Australia trade mark applications).
You may view and print pages of the Site for your own personal, non-commercial use. You may not otherwise copy, modify, distribute, sell, or commercialise any content from the Site without our written permission.
If you would like to share or republish a Anova article, please contact us; we are usually happy to grant permission for non-commercial educational use with appropriate attribution.
8. Links to other websites
The Site may contain links to other websites operated by third parties. We provide these links for your convenience. We are not responsible for the content, availability, or privacy practices of those sites. Linking to a third-party site does not mean we endorse it.
9. Disclaimers and limitation of liability
The Site is provided on an “as is” and “as available” basis. To the extent permitted by law, we exclude all warranties, conditions, and representations regarding the Site, its content, and its availability, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
To the extent permitted by law, we are not liable to you for any loss or damage (including indirect, consequential, or special loss) arising from or in connection with your use of the Site or your reliance on its content. Where our liability cannot lawfully be excluded, our liability is limited (at our option) to re-supplying the relevant content or paying the cost of re-supplying it.
Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies to you under the Australian Consumer Law and that cannot be lawfully excluded.
10. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or damage we suffer as a result of your breach of these Terms or your unlawful use of the Site.
11. Privacy
Our handling of personal information is set out in our Privacy Policy, available at anovahealth.com.au/privacy. The Privacy Policy forms part of these Terms.
We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and (where they apply) by relevant State and Territory health privacy laws.
12. Changes to these Terms
We may update these Terms from time to time. The version date at the top shows when they were last updated. Material changes will be notified through the Site or by email to people who have given us their email address.
Your continued use of the Site after changes take effect indicates your acceptance of the updated Terms.
13. Suspension and termination
We may, at our discretion, suspend or terminate your access to all or part of the Site at any time, with or without notice, including if we believe you have breached these Terms or used the Site unlawfully.
14. Governing law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria, Australia in connection with any dispute arising out of these Terms or the Site.
